Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Emulo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Emulo.

2. Description of Service

Emulo is a competitive sports ranking platform for tennis, pickleball, and padel. The App provides:

  • Bayesian skill-based ratings (OpenSkill / Weng-Lin algorithm)
  • Match logging, confirmation, and live scoring
  • Leaderboards and seasonal rankings
  • Challenges and opponent discovery
  • Quests, achievements, and daily tasks
  • Social features including following, feeds, and reactions
  • Optional paid subscriptions for premium features

3. Eligibility

You must be at least 13 years old to use Emulo. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

4. Account Registration

You must create an account via Apple Sign In or Google Sign In to use Emulo. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account
  • Notify us immediately of unauthorized access
  • Accept responsibility for all activity under your account

You may only maintain one account per person. Creating multiple accounts is prohibited and may result in termination.

5. Acceptable Use

You agree not to:

  • Submit false, fabricated, or manipulated match scores
  • Create multiple accounts to manipulate ratings (boosting or sandbagging)
  • Collude with other players to artificially inflate or deflate ratings
  • Harass, abuse, threaten, or intimidate other users
  • Upload inappropriate, offensive, or illegal content
  • Attempt to reverse engineer, exploit, or manipulate the rating system
  • Use automated tools, bots, or scripts to interact with the App
  • Circumvent rate limits, security measures, or access controls
  • Impersonate another person or misrepresent your identity
  • Use the App for any unlawful purpose

6. Rating System

Emulo uses a Bayesian rating system (OpenSkill / Weng-Lin) to calculate player ratings. Key aspects:

  • Ratings are calculated automatically based on confirmed match results
  • New players start at a default rating with high uncertainty
  • Rating changes depend on the relative skill levels of both players
  • We reserve the right to adjust, reset, or recalculate ratings in cases of verified abuse, system errors, or seasonal resets
  • Ratings are provided for entertainment and competitive purposes — they do not constitute an official sport ranking

7. Match Reporting and Confirmation

  • Both players must confirm match scores for results to be recorded
  • Disputed scores are flagged and may be investigated
  • Players who repeatedly submit false scores may have their accounts suspended
  • Match results are final once both players confirm
  • Live scored matches are auto-confirmed and ratings are updated immediately

8. Subscriptions and Payments

Emulo offers free and paid subscription plans ("Emulo Pro").

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage and cancel subscriptions in your Apple ID account settings (Settings > Apple ID > Subscriptions)
  • The current subscription period cannot be cancelled or refunded once purchased
  • Prices are in USD and may vary by region
  • We reserve the right to change subscription prices with notice
  • Free tier features may change over time

9. User Content

You retain ownership of content you submit (match scores, profile information, comments, messages). By submitting content, you grant Emulo a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the App for the purpose of providing the service.

You are solely responsible for content you post. We may remove content that violates these Terms without notice. Profile photos are automatically moderated for inappropriate content.

10. Intellectual Property

The App, including its design, code, graphics, features, rating algorithms, and branding, is owned by Emulo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our written permission.

11. Reporting and Moderation

Users can report suspicious scores, inappropriate behavior, or other violations through the App. We review reports and may take action including warnings, rating adjustments, temporary suspensions, or permanent bans at our sole discretion.

12. Termination

  • We may suspend or terminate your account at any time for violation of these Terms
  • You may delete your account at any time from Settings > Delete Account
  • Upon deletion, your personal data is permanently removed within 30 days
  • Termination does not entitle you to a refund of any subscription fees
  • Sections that by their nature should survive (intellectual property, limitations of liability, indemnification) will survive termination

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT RATINGS WILL BE PERFECTLY ACCURATE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMULO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Emulo from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

16. Dispute Resolution

Any disputes arising from these Terms or use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Los Angeles County, California. You waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the App.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emulo regarding use of the App.
